HIGH COURT OF JUSTICE.—CHANCERY DIVISION. Company—Name—Similarity of Name of Rival Company—Deception —Injunction—Companies Act 1862.—A company registered in 1902 as the Electromobile Company Limited carried on the business of dealing in electric motor cars. Another company was registered in 1904 as the British Electromobile Company Limited, and carried on a business in some respects similar to that of the former company. At the.date of the formation of the former company and subsequently "electromobile" was a word used in this country, and meact motor cars propelled by electrical power. There was noevidence, beyond the similarity of the names of the two companies, that persons were likely to be deceived by the name of the latter company into thinking that its business was the same as that of the former company. Held, that an injunction would not be granted to restrain the latter company using or carrying on business under the name of the British Electromobile Compmy Limited, and that the case of Daimler Motor Company (1904) Limited v. London Daimler Company Limited (Times newspaper, April 16, 1907) was distinguishable.
